1. Acceptance of Terms

Welcome to BookHotels.co.ke. By accessing and using our website, mobile applications, and services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our Platform.

These Terms constitute a legally binding agreement between you and BookHotels.co.ke ("we", "us", or "our").

2. Definitions

In these Terms, the following definitions apply:

• "Platform": Refers to the BookHotels.co.ke website, mobile applications, and related services.
• "User": Any person who accesses or uses the Platform.
• "Guest": A User who books accommodations through the Platform.
• "Vendor": A property owner or manager who lists properties on the Platform.
• "Property": Any hotel, apartment, villa, resort, lodge, cottage, holiday home, or camp listed on the Platform.
• "Booking": A reservation made by a Guest for a Property through the Platform.
• "Service Fee": The commission charged by BookHotels.co.ke for facilitating bookings.

3. Account Registration

3.1 To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 You must be at least 18 years old to create an account and use the Platform.

3.4 We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or misleading.

4. Booking Process

4.1 The Platform allows Guests to search for and book Properties. When you make a Booking, you enter into a direct contract with the Vendor.

4.2 BookHotels.co.ke acts as an intermediary between Guests and Vendors and is not a party to the rental agreement.

4.3 All Bookings are subject to availability and confirmation by the Vendor.

4.4 Guests are responsible for verifying Property details, amenities, and location before booking.

4.5 Check-in and check-out times are specified by each Property and must be adhered to unless otherwise agreed with the Vendor.

5. Payments

5.1 All payments for Bookings are processed through secure third-party payment gateways.

5.2 Prices displayed on the Platform are in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated.

5.3 We charge a Service Fee for each Booking, which is included in the total price displayed.

5.4 Payment must be completed in full at the time of Booking, unless otherwise specified.

5.5 In the event of a dispute, we may temporarily hold funds until the dispute is resolved.

6. Cancellation Policy

6.1 Cancellation policies vary by Property and are displayed on each Property page.

6.2 Guests may cancel Bookings through their account dashboard or by contacting our support team.

6.3 Refunds are processed according to the Property's cancellation policy and may take 5-10 business days to reflect in your account.

6.4 In case of cancellation by the Vendor, we will assist in finding alternative accommodation or provide a full refund.

6.5 No-shows are considered cancellations and are subject to the Property's cancellation policy.

7. Vendor Terms

7.1 Vendors must provide accurate and complete information about their Properties, including photos, amenities, and pricing.

7.2 Vendors are responsible for maintaining their Properties in good condition and complying with all applicable laws and regulations.

7.3 Vendors must honor confirmed Bookings and may not cancel except in extraordinary circumstances.

7.4 Vendors agree to pay BookHotels.co.ke a commission on each completed Booking.

7.5 Vendors must respond to Booking requests and Guest inquiries within 24 hours.

8. User Conduct

8.1 Users agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform.

8.2 Users must not attempt to gain unauthorized access to any part of the Platform or any other systems or networks connected to the Platform.

8.3 Users must not use the Platform to harass, threaten, or defraud other Users.

8.4 Users must not post false, misleading, or defamatory content.

8.5 Violation of these conduct rules may result in termination of your account.

9. Limitation of Liability

9.1 BookHotels.co.ke is not responsible for any damages, losses, or injuries arising from the use of the Platform or Properties listed on it.

9.2 We do not guarantee the accuracy, completeness, or reliability of Property listings.

9.3 Our maximum liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total amount paid by you for the Booking in question.

9.4 We are not liable for any force majeure events, including but not limited to natural disasters, wars, pandemics, or government actions that affect Bookings.

10. Intellectual Property

10.1 All content on the Platform, including text, graphics, logos, images, and software, is the property of BookHotels.co.ke or its licensors and is protected by copyright and other intellectual property laws.

10.2 Users may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

10.3 Property photos and descriptions provided by Vendors remain their property but grant us a license to display them on the Platform.

11. Termination

11.1 We may terminate or suspend your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other Users, us, or third parties.

11.2 Users may terminate their account at any time by contacting our support team.

11.3 Upon termination, your right to use the Platform will immediately cease.

12. Governing Law

12.1 These Terms shall be governed by and construed in accordance with the laws of Kenya.

12.2 Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Changes to Terms

13.1 We reserve the right to modify these Terms at any time. We will notify Users of material changes via email or through the Platform.

13.2 Continued use of the Platform after changes constitutes acceptance of the modified Terms.
